Accuracy review — August 7, 2026. An attorney’s unsworn argument is generally not evidence. But attorney statements can still have legal significance as stipulations, judicial admissions, representations to the court, offers of proof, or positions that bind a client in particular circumstances.

Argument is not evidence

Facts are ordinarily established through admitted exhibits, sworn testimony, declarations or affidavits authorized by rule, judicial notice, stipulations, and other admissible proof. A lawyer’s opening statement, closing argument, or unsupported factual assertion does not itself prove a disputed fact.

Important exceptions and distinctions

  • Stipulations: parties may formally agree that a fact is established.
  • Judicial admissions: clear factual concessions in pleadings or court can sometimes bind a party.
  • Party-opponent statements: some authorized statements may be admissible under evidence rules.
  • Offers of proof: counsel may explain proposed evidence so an appellate record can be preserved; the explanation is not automatically substantive evidence.
  • Representations to the court: lawyers have duties of candor, and courts may rely on procedural representations while retaining authority to require proof.

How to respond

Object specifically when counsel states a disputed fact without evidentiary support. Ask the court to identify the admitted exhibit, testimony, stipulation, or rule. If the court relies on the statement, request a clear ruling and preserve the transcript. Do not accuse counsel of fraud merely because counsel argued an inference you dispute.

The written record

Pleadings define claims and defenses but are not automatically evidence of every allegation. A declaration under penalty of perjury may serve as evidence when the governing rule permits and the statement is based on personal knowledge and otherwise admissible.
